📘 What HB 174 Does

House Bill 174 would change Maryland law so that owners of motor vehicles and boats (“marine vessels”) can name a beneficiary to inherit the title automatically when they die. Previously, only sole owners of motor vehicles could do this. Under the new bill:

  • Boat owners (either an individual sole owner or co-owners listed as joint tenants with right of survivorship or tenants by the entirety) can designate a transfer-on-death (TOD) beneficiary with the Department of Natural Resources.
  • Motor vehicle co-owners with certain forms of shared ownership can also designate a TOD beneficiary with the Motor Vehicle Administration.
  • The vehicle or vessel stays in the owner’s name during life and only transfers to the beneficiary upon the owner’s death.
  • The beneficiary must apply for a new title after the owner’s death and provide the original title, death certificate, ID, and applicable fees.
